Swadden & Company has provided top quality legal services since 1988.  Our firm is comprised of 22 lawyers who practice in the areas of personal injury, family, insurance defence, real estate, corporate and commercial law.

In addition to our large insurance defence practice, our firm acts for plaintiffs with personal injury claims, pursues and defends litigation arising from disputes over estates, provides estate planning advice and prepares Wills, assists with probate applications and estate administration, incorporates companies, assists with corporate reorganizations, and handles real estate sales, purchases, and mortgages.

Our lawyers range in experience from one year to 50 years.  We have appeared before all levels of court in British Columbia and have conducted numerous jury trials.  We have participated in arbitrations and in hundreds of mediations.

Estate Litigation

We pursue and defend litigation arising from disputes over the contents of Wills.  If you feel you have been disinherited or have been left an inadequate share of a loved one’s estate, or if a claim is brought against you, we can help.  We understand that such disputes are emotionally charged, and our goal will be to help resolve the dispute fairly and as amicably as possible, with a minimum of damage to the estate.

Insurance Defence

Our main insurance client is the Insurance Corporation of British Columbia.  Our lawyers have defended personal injury claims on behalf of ICBC since 1976.  Each of the lawyers in our firm has a substantial insurance defence practice.  We represent ICBC in all courts in BC and have defended ICBC and its insureds against claims alleging traumatic brain injuries, serious orthopaedic injuries, degenerative conditions, soft tissue injuries, chronic pain, and psychological injuries.

We have over 200 years of insurance defence experience.  This experience, combined with our technologically advanced office, allows us to achieve measured, expeditious, and cost-effective results in an increasingly complex area of legal practice.

Lawyers in our firm have acted for other insurance companies, and the firm welcomes enquiries from other insurers wishing to engage new defence counsel.

Incorporations and Corporate Law

Our firm has extensive experience incorporating companies for professional persons and small businesses, both provincially and federally.  We can offer advice on whether incorporation is appropriate for you and on the best corporate structure to meet your and your family’s needs.  We can assist with the reorganization of existing companies, including corporate freezes.

Once you are incorporated, we can keep your company in good standing and service your ongoing corporate needs.

Real Estate Transactions

We can offer competitively priced assistance with the sale, purchase, and mortgage of your home or commercial property.  Our conveyancing department will make the process as straight forward and convenient as possible.

Wills and Estate Planning

We can help you to develop a plan to reflect your true testamentary wishes and can then prepare a Will that embodies that plan.  A professionally prepared estate plan and Will reduce the risk of estate litigation and unwelcome probate fees and taxation.  We have excellent relationships with independent financial planners and chartered accountants and can, when appropriate, make referrals to assist with this process.  Without a Will, your estate will be governed by the rules of intestate succession, which may not reflect what you want for your loved ones.  Everyone needs a Will.  You should not leave this until it is too late.

Probate and Estate Administration

If a loved one has passed away, we can assist you to obtain probate of the loved one’s Will or a grant of administration.  We can also help with all aspects of the administration of the estate, including the preparation of an inventory of assets and liabilities, the payment of bills and debts, the sale of real property, and the ultimate distribution of the estate.
